General Terms and Conditions of Sale mypetitfute.fr (V1-31/03/2021)

Article 1: Purpose

These General Terms and Conditions of Sale apply to all orders received by Nouvelles Editions de l'Université and are valid at the time the order is placed.

The seller reserves the right to modify its conditions of sale at any time. In this case, the applicable conditions will be those in force at the date of the order by the buyer.

By creating an account, the customer expressly accepts all the terms of these GTC.

These terms and conditions can be consulted at any time on the website www.mypetitfute.fr and may change over time.

Article 2: Availability and access to the mypetitfute.fr website

The client acknowledges that they have the necessary skills and means to access and use the mypetitfute.fr website. The site is accessible to the customer 24 hours a day, 7 days a week, unless otherwise specified.

Nouvelles Editions de l'Université may not be held liable for technical unavailability of the connection, whether this is due to force majeure, maintenance, updating, modification of the site, intervention by the host, an internal or external strike, a network failure, a power cut, or even poor configuration or use of the customer's computer.

The customer certifies that they have taken all appropriate measures to protect their own data and/or software from contamination by any viruses circulating on the Internet. The client acknowledges that they use the mypetitfute.fr website at his/her own risk.

The cost of using the remote communication technique is as follows: with the exception of the price of acquiring the Petit Futé customised guide (digital), the client must provide for the cost of supplying Internet access to access the mypetitfute.fr site. This cost is paid directly by the client to his Internet service provider.

Article 3: Orders

For any question relating to an order, the client can contact us at the following address: contact@mypetitfute.fr

The services on this site are described as explicitly as possible. Updates may occur at any time without notice. The photographs, drawings and texts are for illustrative purposes only and are not contractually binding.

Once the order has been placed by the customer, Nouvelles Editions de l'Université will send the customer an order confirmation by e-mail as soon as possible, containing all the information communicated and in particular:

  • the essential characteristics of the service ordered
  • the indication of the price including VAT
  • where applicable, any difficulties or reservations relating to the order placed

The contract is only concluded as of the confirmation of the order by e-mail

Article 4: Prices

The prices are indicated in Euro, all taxes included. The amount of the services is calculated on the basis of the online price list in force at the time the order is registered.

The VAT rate that may be applicable is that in force on the day of the order.

Article 5: Payment

Orders, regardless of their origin, are payable immediately in Euros, using a secure payment system (Stripe). The payment of purchases is made by credit card.

Once the order has been validated and payment made, an order confirmation e-mail will be sent to the customer.

Article 6: Delivery

A delivery email containing a download link to the Petit Futé customised guide in epub or PDF version will be sent to the customer within 120 minutes of the purchase.

Article 7: Guarantee

Nouvelles Editions de l'Université does not guarantee the accessibility of the Internet or its uninterrupted and error-free operation. The Internet is an open network and Nouvelles Editions de l'Université makes every effort to protect your confidential data.

Article 8: Right of withdrawal and return of purchased guides

Customised guides in digital form are products excluded from the right of withdrawal.

In accordance with the regulations in force, the right of withdrawal cannot be exercised for customised books. Article L. 121-20-2, 3 of the French Consumer Code.

Customised guides purchased cannot therefore be returned or exchanged.

If the file of the guide purchased in epub or PDF format is altered, Nouvelles Editions de l'Université will replace the file within 24 working hours following receipt of the complaint, after checking the non-conformity or the defect.

Article 9: Processing of the customer's personal data

Each of the Parties undertakes, for the processing that concerns it, to comply with EU Regulation 2016/679 on the protection of personal data.

As part of the performance of these GTC, Nouvelles Editions de l'Université may collect and process personal data concerning the customer: surname, first name, e-mail address, location data.

The information is kept for the entire duration of the contractual relationship and for 10 years after the end of it.

Customers have the rights provided for in the applicable regulations.

Article 10: Intellectual property

Petit Futé, its logo and any other brand or logo appearing on the site www.mypetitfute.fr are registered trademarks protected by the legal provisions applicable to intellectual property rights.

Any reproduction, even partial, of the www.mypetitfute.fr site is prohibited.

The models, drawings, logos, objects and images offered by the www.mypetitfute.com site are the property of Nouvelles Editions de l'Université and are protected by intellectual property law.

The customer acknowledges that the use they may make of the personalised guides is strictly limited to private use.

The reproduction, marketing, distribution and publication of personalised guides are strictly prohibited and are likely to constitute acts of counterfeiting liable to criminal and civil penalties.

Article 11: Dispute - Applicable law

Online sales by Nouvelles Editions de l'Université are governed exclusively by French law.

In the event of a dispute, the courts of Paris shall have sole jurisdiction.

Article L211-4 of the Consumer Code

The seller is obliged to deliver goods in conformity with the contract and is responsible for any defects in conformity existing at the time of delivery. The seller is also liable for any lack of conformity resulting from the packaging, the assembly instructions or the installation when the latter was made his responsibility by the contract or was carried out under his responsibility.

Article L211-4 Consumer Code

To be in conformity with the contract, the goods must :

  • Be fit for the purpose usually expected of similar goods and, where applicable :
    • correspond to the description given by the seller and possess the qualities that the seller presented to the buyer in the form of a sample or model
    • have the qualities that a buyer may legitimately expect in view of the public statements made by the seller, the producer or his representative, in particular in advertising or labelling
  • Or have the characteristics defined by mutual agreement between the parties or be fit for any special purpose sought by the buyer, brought to the attention of the seller and accepted by the latter.

Article L211-12 Consumer Code

The action resulting from the lack of conformity is prescribed by two years from the delivery of the goods.

Article 1641 Civil Code

The seller is bound by the guarantee for hidden defects in the thing sold which make it unfit for the use for which it was intended, or which so diminish this use that the buyer would not have acquired it, or would only have given a lesser price, if he had known about them.

Article L211-4 Consumer Code

The action resulting from redhibitory defects must be brought by the buyer within two years of the discovery of the defect.
